PRELIMINARY ARTICLE : GENERAL PROVISIONS

The present general conditions shall apply, unless specific arrangements, the provision of "at-Home Chef – Caterer and event Organizers" provided by PARIS GASTRONOMY. Any order implies automatically the membership of these terms and conditions.

The signature of the quote implies that the Client accepts these terms and conditions of sale, agrees that they have perfect knowledge, and waives its own conditions of purchase or other conditions.

All information and any photograph contained on our website or on other media is the property of PARIS GASTRONOMY and may be used only under the written agreement of the PARIS GASTRONOMY. These general conditions of sale are accessible at any time on the website www.benjaminlemoal.com.

SECTION 1 : PRODUCT

The products offered for sale are those listed on the website PARIS GASTRONOMY, www.benjaminlemoal.comat the time of the order of the Customer, and subject to availability. PARIS GASTRONOMY reserves the right to change the offer at any time. In all cases, PARIS GASTRONOMY reserves the right to refuse orders in case of unavailability of the products.

All the products in the offer are in accordance with the regulations and standards in force in France or in the European Union. The delivered products must be kept in optimal conditions, that is, between 0 and + 4°C, and to be consumed immediately after preparation, or within 6 hours after delivery.

The Client must inform PARIS GASTRONOMY before placing an order from any requirement of menu to be consistent with its religious beliefs. In the case of food allergies or intolerances, the Customer shall check the ingredients list on the site and ensure that it does not contain food allergens.

ARTICLE 2 : DELIVERY

PARIS GASTRONOMY offers its Customers an at-home Chef, offering the preparation of dinners, lunches, and cocktails at the home of Customers or on all of the reception place of their choice. PARIS GASTRONOMY also offers services such as dressing table, the table service, and the sale of food products or not.

PARIS GASTRONOMY agrees to restore the premises after the delivery, but will not proceed to the cleaning of the dishes provided (plates, glasses, cutlery...).

ARTICLE 3 : PAYMENT

The rates confirmed on the estimate, signed and validated by the client, cannot be changed. All orders are firm and final. The payment is carried out as follows :

A 50% deposit of the total price inclusive of VAT of the estimate is due to the validation of the order.
The balance of the invoice is due upon receipt thereof, except for companies with a period of 30 days.

In the event of default or late payment, default interest will be applied and a collection fee of 40 € will be charged. Further compensation may be required in case of recovery costs higher.

ARTICLE 4 : THE ABSENCE OF THE RIGHT OF WITHDRAWAL

Because of their nature, the ordered products are likely to deteriorate, and can not be returned. Therefore, the Client does not benefit from a right of withdrawal of 14 days for Product orders.

Any order canceled or changed outside of the agreed terms will result in an allowance equal to 100 % of the total amount of the order, management fees included.

SECTION 5 : PERFORMANCE OF THE SERVICES AND TIME LIMITS

PARIS GASTRONOMY strives to adhere to the time schedule specified in the quotation or purchase order. However, his responsibility may not be incurred in the following cases :

Non-compliance with the payment obligations by the Customer.
Premises not available as expected.
Unexpected delays related to its suppliers, or in case of force majeure.

In case of delay or impossibility of performance due to force majeure, PARIS GASTRONOMY may suspend or cancel the service without incurring any liability.

ARTICLE 6 : PRICES

The prices of the menus are those shown on the site www.benjaminlemoal.com at the time of the order. The services are billed based on the number of people and the type of the selected menu. The above prices are in euros, all taxes included.

Rates do not include the cost of delivery and travel, which are charged separately.

ARTICLE 7 : USE – REPAIR – NON-RESTITUTION OF THE DISHES AND LEASED EQUIPMENT

The Customer undertakes to use the rented equipment in accordance with its destination usual and to ensure its maintenance. The Customer is responsible for any damage to or failure to return the rented equipment, which will be billed to the amount of its replacement value as new.

ARTICLE 8 : TAX PROVISIONS

Prices are subject to VAT rate of 10 % for food and non-alcoholic beverages. In the case of changes to these rates, the price will be adjusted accordingly.

SECTION 9 : CLAIMS AND LITIGATION

The Customer is required to check the conformity of the products to the delivery. All claims must be made within 2 days of delivery. The disputes relating to the billing should be sent within 8 days of the receipt of the invoice.

In case of disagreement, the Paris Commercial Court is the only competent authority.

ARTICLE 10 : LIABILITY AND INSURANCE

The Customer is responsible for the damages caused by him or his guests in the delivery. It is required to have liability insurance as well as insurance homeowners. PARIS GASTRONOMY is responsible for its services, but will not be held responsible for damages caused by the Client or its guests.

ARTICLE 11 : PROTECTION OF PERSONAL DATA

The data collected on the site www.benjaminlemoal.com will be used for the management of the orders and actions of commercial prospecting. The Client may exercise his rights of access, rectification, opposition or deletion of his personal data by sending a request by registered mail.

ARTICLE 12 : INTELLECTUAL PROPERTY

All elements of the site PARIS GASTRONOMY are the exclusive property of the company. It is prohibited to reproduce, modify, or use of any element of the website without prior written permission.

ARTICLE 13 : OTHER EXPENSES

The shipping cost will be charged in addition to, in particular beyond the paris region, on the basis of real costs.

ARTICLE 14 : AMENDMENTS

PARIS GASTRONOMY reserves the right to modify its General terms and Conditions of Sale at any time. The applicable conditions will be those in force at the time of the order.
