Any order implies automatically the membership of these terms and conditions.<\/p><p data-start=\"588\" data-end=\"798\">The signature of the quote implies that the Client accepts these terms and conditions of sale, agrees that they have perfect knowledge, and waives its own conditions of purchase or other conditions.<\/p><p data-start=\"800\" data-end=\"1165\">All information and any photograph contained on our website or on other media is the property of <strong data-start=\"485\" data-end=\"506\">BENJAMIN LE MOAL <\/strong>and may be used only under the written agreement of the <strong data-start=\"485\" data-end=\"506\">BENJAMIN LE MOAL <\/strong>. The delivered products must be kept in optimal conditions, that is, between 0 and + 4\u00b0C, and to be consumed immediately after preparation, or within 6 hours after delivery.<\/p><p data-start=\"1960\" data-end=\"2287\">The Client must inform <strong data-start=\"485\" data-end=\"506\">BENJAMIN LE MOAL<\/strong>\u00a0before placing an order from any requirement of menu to be consistent with its religious beliefs. In the case of food allergies or intolerances, the Customer shall check the ingredients list on the site and ensure that it does not contain food allergens.<\/p><hr data-start=\"2289\" data-end=\"2292\" \/><h3 data-start=\"2294\" data-end=\"2323\"><strong data-start=\"2297\" data-end=\"2323\">ARTICLE 2 : DELIVERY<\/strong><\/h3><p data-start=\"2325\" data-end=\"2678\"><strong data-start=\"485\" data-end=\"506\">BENJAMIN LE MOAL<\/strong> offers its Customers an at-home Chef, offering the preparation of dinners, lunches, and cocktails at the home of Customers or on all of the reception place of their choice. <strong data-start=\"485\" data-end=\"506\">BENJAMIN LE MOAL <\/strong>\u00a0also offers services such as dressing table, the table service, and the sale of food products or not.<\/p><p data-start=\"2680\" data-end=\"2866\"><strong data-start=\"485\" data-end=\"506\">BENJAMIN LE MOAL\u00a0<\/strong> agrees to restore the premises after the delivery, but will not proceed to the cleaning of the dishes provided (plates, glasses, cutlery...).<\/p><hr data-start=\"2868\" data-end=\"2871\" \/><h3 data-start=\"2873\" data-end=\"2900\"><strong data-start=\"2876\" data-end=\"2900\">ARTICLE 3 : PAYMENT<\/strong><\/h3><p data-start=\"2902\" data-end=\"3068\">The rates confirmed on the estimate, signed and validated by the client, cannot be changed. All orders are firm and final. The payment is carried out as follows :<\/p><ul data-start=\"3070\" data-end=\"3264\"><li data-start=\"3070\" data-end=\"3156\">A 50% deposit of the total price inclusive of VAT of the estimate is due to the validation of the order.<\/li><li data-start=\"3157\" data-end=\"3264\">The balance of the invoice is due upon receipt thereof, except for companies with a period of 30 days.<\/li><\/ul><p data-start=\"3266\" data-end=\"3499\">In the event of default or late payment, default interest will be applied and a collection fee of 40 \u20ac will be charged. However, his responsibility may not be incurred in the following cases :<\/p><ul data-start=\"4191\" data-end=\"4359\"><li data-start=\"4191\" data-end=\"4247\">Non-compliance with the payment obligations by the Customer.<\/li><li data-start=\"4248\" data-end=\"4291\">Premises not available as expected.<\/li><li data-start=\"4292\" data-end=\"4359\">Unexpected delays related to its suppliers, or in case of force majeure.<\/li><\/ul><p data-start=\"4361\" data-end=\"4533\">In case of delay or impossibility of performance due to force majeure, <strong data-start=\"485\" data-end=\"506\">BENJAMIN LE MOAL <\/strong>\u00a0may suspend or cancel the service without incurring any liability.<\/p><hr data-start=\"4535\" data-end=\"4538\" \/><h3 data-start=\"4540\" data-end=\"4565\"><strong data-start=\"4543\" data-end=\"4565\">ARTICLE 6 : PRICES<\/strong><\/h3><p data-start=\"4567\" data-end=\"4822\">The prices of the menus are those shown on the site <a href=\"https:\/\/benjaminlemoal.com\/en\/\">www.benjaminlemoal.com<\/a> at the time of the order. The services are billed based on the number of people and the type of the selected menu. The above prices are in euros, all taxes included.<\/p><p data-start=\"4824\" data-end=\"4925\">Rates do not include the cost of delivery and travel, which are charged separately.<\/p><hr data-start=\"4927\" data-end=\"4930\" \/><h3 data-start=\"4932\" data-end=\"5026\"><strong data-start=\"4935\" data-end=\"5026\">ARTICLE 7 : USE \u2013 REPAIR \u2013 NON-RESTITUTION OF THE DISHES AND LEASED EQUIPMENT<\/strong><\/h3><p data-start=\"5028\" data-end=\"5288\">The Customer undertakes to use the rented equipment in accordance with its destination usual and to ensure its maintenance. The Customer is responsible for any damage to or failure to return the rented equipment, which will be billed to the amount of its replacement value as new.<\/p><hr data-start=\"5290\" data-end=\"5293\" \/><h3 data-start=\"5295\" data-end=\"5335\"><strong data-start=\"5298\" data-end=\"5335\">ARTICLE 8 : TAX PROVISIONS<\/strong><\/h3><p data-start=\"5337\" data-end=\"5535\">Prices are subject to VAT rate of 10 % for food and non-alcoholic beverages. In the case of changes to these rates, the price will be adjusted accordingly.<\/p><hr data-start=\"5537\" data-end=\"5540\" \/><h3 data-start=\"5542\" data-end=\"5584\"><strong data-start=\"5545\" data-end=\"5584\">SECTION 9 : CLAIMS AND LITIGATION<\/strong><\/h3><p data-start=\"5586\" data-end=\"5864\">The Customer is required to check the conformity of the products to the delivery. All claims must be made within 2 days of delivery.
